Dear Valued Customer, Fabtech Industries Inc hereby advises its customers of Proposition 65, known as the Safe Drinking Water and Toxic Enforcement Act, enacted in California in 1986. The Act requires that anyone in the course of doing business who exposes an individual in California to a chemical “known to the State” to cause cancer or reproductive toxicity must first give a “clear and reasonable” warning.
On August 30, 2016, the California Office of Environmental Health Hazard Assessment (“OEHHA”) adopted various changes to the “clear and reasonable” warnings required by Proposition 65. Among other things, the new warning regulation rewrites the “safe harbor” warning label text and format, including the mandatory use of a warning symbol and reference to an official OEHHA website, and mandatory internet and catalog point-of-sale warnings. The new requirements take effect on August 30, 2018.
In order to ensure compliance with Prop 65, Fabtech products distributed and/or sold in California by Fabtech Industries or any of its customers after August 30, 2018 is required to display a compliant Prop 65 warning statement on the product box or product itself. For your information the following warning statement is considered compliant for the products:

Fabtech will affix labels to its products that are affected by this mandated law that could be sold or otherwise delivered by third-parties to consumers in California as of August 30, 2018. Sellers of Fabtech products must not cover or alter the affixed Prop 65 label for consumers in California. Product received from Fabtech prior to August 30, 2018 is not required to be labeled.
Should your company sell any Fabtech product through a website or catalog, the same warning must be provided on the website or in the catalog. It is your responsibility for your website and / or catalog that the warning must be provided by including either the warning label graphic or a clearly marked hyperlink using the word “WARNING” on the product display page, or by otherwise prominently displaying the warning to the purchaser prior to completing the purchase.
As a seller of product there may be certain Prop 65 laws that applies to your company that are not stated in this notice. You should contact the state of California for proper compliance to avoid possible fines.
Fabtech requires that all its customers who sell any Fabtech product in California will comply with this policy, including by ensuring that the appropriate Prop 65 warning statement is provided to any consumer in California who purchases or receives Fabtech product as of August 30, 2018.
